1. Acceptance of terms

By accessing or using the NosHQ platform, you agree to be bound by these Terms of Service. If you are using NosHQ on behalf of a business, you represent that you have authority to bind that business to these terms.

2. Description of service

NosHQ provides a cloud-based restaurant management platform including order management, kitchen display systems, floor plan management, staff scheduling, stock control, allergen tracking, and business reporting. The platform is provided as a hosted service accessible via web browsers.

3. Accounts and access

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials, including staff PINs.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect unauthorised access to your account.
  • Account owners can invite team members and assign roles with specific permissions. You are responsible for managing these access levels.

4. Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorised access to other users' accounts or data.
  • Interfere with or disrupt the platform or its infrastructure.
  • Reverse engineer, decompile, or disassemble any part of the platform.
  • Use automated tools to scrape or extract data from the platform without our written consent.

5. Your data

You retain ownership of all data you enter into NosHQ, including menu items, orders, staff records, and business data. We do not claim ownership of your content.

You grant us a limited licence to host, process, and display your data solely for the purpose of providing the NosHQ service to you.

We handle your data in accordance with our Privacy Policy.

6. Service availability

We strive to keep NosHQ available at all times, but we do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will provide reasonable notice for planned maintenance where possible.

7. Payment and billing

Certain features of NosHQ may require a paid subscription. Payment terms, pricing, and billing cycles will be communicated at the time of subscription. All fees are non-refundable unless otherwise stated or required by law.

8. Limitation of liability

To the fullest extent permitted by law, NosHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform.

Our total liability for any claim arising from these terms or your use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access if you breach these terms, with reasonable notice where possible. Upon termination, we will retain your data for 90 days to allow you to export it, after which it will be deleted.

10. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email or through a notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
